Terms of Service

Welcome to BrainStorma AI ("we", "us", "our"), a service operated by Atlas Buildings Works Limited. By creating an account, purchasing credits, or otherwise accessing or using AI tools, BrainStorma AI (the "Service"), you ("you", "user") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. About the Service

BrainStorma AI is a paid, cloud-based chat interface that allows you to interact with multiple large-language-model providers (including, but not limited to, OpenAI, Anthropic, DeepSeek, and others). You purchase credits as one-time transactions that are consumed as you send messages or generate content. BrainStorma AI does not operate a recurring subscription. The underlying models are third-party services; we only provide the interface and billing layer.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract. By registering, you confirm that you meet these requirements and have confirmed your age at signup.

3. Accounts & Security

  • Accurate Information: You agree to provide truthful, complete registration details.
  • Passwords: You are responsible for safeguarding your password and any activity under your account. Notify us immediately at contact@brainstorma-ai.com if you suspect unauthorized use.
  • One Account Per Person: Creating multiple accounts to obtain promotional credits or circumvent limits is prohibited.
  • Email Verification: You must verify your email address before purchasing credits or accessing paid functionality.

4. Credits & Billing

  • Credits: Pre-paid units purchased as one-time transactions and used to pay per-request fees charged by underlying LLM providers. BrainStorma AI does not operate a recurring subscription.
  • Pricing: Displayed at checkout; may change, but changes do not affect already-purchased credits.
  • Refunds: Credits are non-refundable except where required by law or if we terminate the Service without cause.
  • Expiration: Credits are valid for 90 days from the date of purchase. Unused credits expire after this period.
  • Chargebacks: Initiating a chargeback without contacting us first will result in immediate account suspension.
  • Statement Descriptor: Card statements will show "BRAINSTORMAAI" as the descriptor for any credit purchase.

5. Acceptable Use Policy

You may not use the Service to: violate any law or regulation; generate or disseminate spam, malware, hate speech, harassment, sexually explicit content involving minors, or violence-inciting material; attempt to reverse-engineer, jailbreak, or extract the underlying model weights or system prompts; share login credentials or resell access to third parties. We reserve the right to suspend or terminate accounts that breach these rules without refund.

6. Intellectual Property

  • Your Inputs: You retain ownership of text you submit.
  • Your Outputs: To the extent permitted by law, any text generated is yours.
  • Pre-existing Rights: The models and software are licensed to us; nothing in these Terms grants you rights to them.

7. Third-Party Models & Disclaimers

We rely on external LLM providers. No Warranty: We do not guarantee accuracy, completeness, or reliability of any output. Use at Your Own Risk: You are responsible for fact-checking and complying with laws when using generated content.

8. Limitation of Liability

To the maximum extent permitted by law, Atlas Buildings Works Limited and its officers, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

9. Indemnification

You agree to defend, indemnify, and hold harmless Atlas Buildings Works Limited from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your account at any time for cause (e.g., breach of Terms or suspected fraud). Upon termination, your right to use the Service ceases immediately, and any unused credits may be forfeited.

11. Changes to the Terms

We may update these Terms at any time. Material changes will be announced via email or in-app notification at least 7 days before taking effect. Continued use after the effective date constitutes acceptance.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of England & Wales. Any dispute shall first be attempted to be resolved informally; if unresolved, it shall be submitted to the exclusive jurisdiction of the courts of England & Wales.
